Terms of Service

These terms are an agreement between you and Clearday (“Clearday,” “we” or “us”) covering your use of the Clearday website and app. By creating an account or using Clearday, you agree to them and to our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old and able to form a binding contract. You may only link accounts that you own or are authorized to access, and you are responsible for keeping your password and any two-factor device secure. Tell us promptly if you believe someone else has used your account.

Clearday reads your financial accounts, through Plaid or from information you enter, and calculates what is clear to spend after your bills, card statements, loan payments and buffer. It also forecasts bills and paychecks, models debt payoff strategies, runs a financial health check, sends a weekly digest and bill reminders, and offers an AI assistant, Clearday AI.

We may add, change or remove features over time. If we remove something central to what you pay for, we will tell you in advance.

Clearday is not a bank. It does not hold, move, transfer or pay money, and it cannot initiate transactions on any of your accounts. Your deposits and debts remain with your own institutions.

Clearday does not give financial, investment, tax or legal advice. It is not a registered investment adviser, broker-dealer, financial planner, tax preparer or certified public accountant, and no fiduciary relationship exists between you and us. Its figures, forecasts, plans and assistant answers are educational guidance based on the data available to it. You are responsible for your own financial decisions. For decisions with significant consequences, consult a qualified professional.

Clearday Plus costs $12 per month or $96 per year, in US dollars, plus any applicable taxes. Payments are processed by Stripe.

A subscription renews automatically at the end of each billing period, at the price then in effect, until you cancel. We will tell you before any price change applies to you, and you can cancel before it takes effect.

Except where the law requires otherwise, payments are non-refundable and we do not provide credits for partial periods.

New accounts start with a 14-day free trial. No payment card is required, and the trial does not convert to a paid subscription on its own.

When a trial ends without a subscription, or a subscription ends, your data stays viewable. Bank syncing and the assistant pause until you subscribe.

You can cancel anytime from Settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.

You agree not to:

• Link or access accounts you are not authorized to use.
• Use Clearday for anything unlawful, fraudulent or harmful.
• Probe, scan or test the security of the service, or bypass its limits, except through responsible disclosure to us.
• Access the service by automated means, or scrape, copy or resell it.
• Reverse engineer the service, except where the law allows it.
• Interfere with the service or other people's use of it.
• Use the assistant to generate content that is unlawful, or to attempt to extract other users' data.

Your financial data belongs to you. You give us permission to store and process it only to provide and improve the service for you, as described in the Privacy Policy. You can export or delete it at any time from Settings.

Cleardayrelies on third parties, including Plaid for bank connections, Stripe for payments and Anthropic for the AI model. Your use of Plaid is also governed by Plaid's end user privacy policy, which it shows you when you connect.

We are not responsible for the accuracy, availability or conduct of third-party services or your financial institutions. In particular, balances and transactions are only as current and correct as the data those institutions provide.

The service is provided “as is” and “as available.” To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We work hard to make every figure correct, but we do not guarantee that the service will be uninterrupted or error-free, that bank data will be complete or current, or that any forecast, calculation or assistant answer is accurate or suitable for your situation. Check important figures against your statements before acting on them.

To the extent the law allows, Clearday will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, overdraft or late fees, lost data or financial losses arising from decisions you make, even if we were told they were possible.

Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $50.

Some jurisdictions do not allow these limits, so some of them may not apply to you.

You can stop using Clearday and delete your account at any time from Settings.

We may suspend or close your account if you breach these terms, if required by law, or to protect the service or other users. Where reasonable, we will give notice and a chance to export your data first. Sections that by their nature should survive termination, including disclaimers and limitation of liability, will survive.

These terms are governed by the laws of the jurisdiction in which Clearday is organized, without regard to conflict-of-law rules.

We may update these terms. We will change the date at the top, and for material changes we will tell you by email or in the app before they take effect. Continuing to use Clearday after that means you accept the updated terms.
